Terms of Service

Welcome to Wayheld (“Wayheld,” “we,” “us,” or “our”). These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Wayheld governing your access to and use of the website located at wayheld.com, our web application, and any associated services, software, tools, and content (collectively, the “Platform”).

By creating an account, initiating a journey plan, purchasing points or a membership subscription, or otherwise accessing the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately discontinue your use of the Platform.

Wayheld is a slow travel companion engineered to help travelers compose intentional, regenerative itineraries. Unlike high-volume tourist aggregators, Wayheld emphasizes cultural preservation, unhurried pacing, and respect for local ecosystems.

Our platform provides generative AI journey planning, localized discovery intelligence, points wallets, and personalized travel recommendations. We do not operate as an airline, lodging carrier, or licensed travel agency; all bookings, accommodations, and transit choices remain the sole prerogative of the traveler.

To access journey creation and dashboard features, you must register for an account. You represent and warrant that:

• You are at least 18 years of age (or the age of majority in your jurisdiction).
• All registration details you submit are accurate, current, and complete.
• You will maintain the confidentiality of your password and credentials.
• You are solely responsible for all activities occurring under your account.

You agree to notify Wayheld immediately of any unauthorized access or breach of account security. Wayheld reserves the right to suspend or terminate accounts that provide false information or violate these Terms.

1. Membership Tiers & Purchases: Wayheld offers complimentary tiers (Free), one-time journey purchases (Pay-Per-Trip), and recurring memberships (Ongoing Companion). Plan details, pricing, and point quotas are displayed on our Billing page.

2. Stripe Payment Processing: All financial transactions, recurring billing, and card storage are processed securely through Stripe, Inc. By purchasing a plan or credit bundle, you authorize Stripe to charge your designated payment method for all applicable fees. Wayheld does not store raw credit card numbers on its servers.

3. Automatic Renewal & Cancellation: Ongoing Companion memberships renew automatically on a monthly basis until canceled. You may cancel your subscription at any time via your Dashboard Billing portal. Cancellations take effect at the conclusion of the current billing period.

4. Point & Credit Ledger: Points granted or purchased represent limited, non-transferable digital licenses to utilize compute services on the Platform. Points hold no monetary cash value and are non-refundable except as set forth in our Refund Policy.

Wayheld utilizes advanced artificial intelligence models (including Anthropic Claude) alongside Google Places geospatial intelligence to compose itineraries, suggest stays, and craft personalized recommendations.

While we strive for historical accuracy, geographic coherence, and cultural sensitivity, all AI-generated itineraries, opening hours, prices, transit schedules, and route estimates are advisory in nature. You are solely responsible for verifying operational hours, visa requirements, seasonal closures, road conditions, and personal safety advisories before embarking on your journey.

Wayheld Intellectual Property: The Wayheld name, trademarks, logos, UI designs, code, algorithms, and brand assets are the exclusive property of Wayheld and protected under international copyright and trademark laws.

User Content & Export: You retain ownership of any notes, uploaded preferences, custom stops, and saved places you create on the Platform. You are granted a permanent, non-exclusive license to export, print, and share your personal journey itineraries for non-commercial travel purposes.

You agree not to engage in any of the following prohibited behaviors:

• Using automated scrapers, bots, or extraction scripts to harvest data or intelligence from the Platform.
• Reselling, sublicensing, or syndicating Wayheld journey outputs as an uncredited commercial service.
• Attempting to probe, exploit, or bypass platform security, rate limits, or payment mechanisms.
• Uploading harmful code, spam, defamatory content, or infringing material.

To the maximum extent permitted by applicable law, in no event shall Wayheld, its founders, affiliates, employees, or partners be liable for any indirect, incidental, punitive, consequential, or special damages arising out of your use of the Platform or your physical travels, including but not limited to travel delays, injuries, property loss, canceled flights, or unexpected venue closures.

Our total cumulative liability for any claim arising out of these Terms or your use of the Platform shall not exceed the amount paid by you to Wayheld in the twelve (12) months preceding the event giving rise to the claim.

We reserve the right to update or modify these Terms at any time. When material changes occur, we will update the “Last Updated” date at the top of this document and notify active members via email or an in-app banner.

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles.
